Dear Governor:

I have been recently employed by Mitchell Peak Park Commission in the matter of condemnation of Mt. Mitchell lands. I have instituted suit and have made summons returnable on the 28th inst.

I am advised that you have had an agreement with Perley & Crocket that they would not cut any timber on the area sought to be condemned, but I am further advised by Mr. E. F. Watson, of the Commission, that they are now cutting timber on said lands. In the event that they are cutting the timber on this tract as Mr. Wat- has been advised, you can probably get them to cease cutting until the commission is appointed to appraise the lands. Otherwise, I ask your advice as to securing a restraining against them pending the suit for condemnation.

Please advise me at your earliest convenience.
